When is the next congress session? is it in Nov/Dec (the so called lame-duck session). I am wondering about chances of having some immigration measures during that session. Being a lame-duck session, do congressmen can take up a serious measure like immigration for discussion (either CIR or SKIL)? If not - is it possible to introduce some highly desirable stop-gap measures like: ability to apply for 485 during retrogession; recapturing the unused visa numbers from previous years with soft country limits (as is done a few years back); and faster backlog reduction at BEC�s. In short I am wondering about our strategy for next 4-5 months; and is there a hope - however small it maybe � hope of getting something done this year; Or our only hope is with next congress?

I-140 -EB3 - TSC- Approved 08/06.
I-140-EB2 - Pending at TSC. RD 04/25/07 based on Perm to port 09/04 PD.
I-485/EAD/AP filed at NSC on 08/03/07. RD 08/06/07.
I guess longway to go for getting receipts.

Did you noticed any LUD before check cashing as you got receipt from california. I filed on July 20 and no news yet.
Not sure of LUD. Today I checked online account and I saw checks got cashed and receipt #'s starting with WAC at the back of the check.
Waiting for the scanned copies of receipts from Attorney.

Been in the US since 1998, have an EB-2 PD of 2001, have played by the rules all along. Still no GC... And, the dates are going back to 2000 from the new year.. I've lost hopes...
A: I suggest you to have a trip in India and visit some places like Dharavi,

I'm pretty close to getting clinical depression because of this game played by USCIS, Labor Dept, FBI and my own bad luck.

It means they have used 90K Visa out of 140-150K ..it means 50K visa left for next 5 month..not sure how much visa dates wlll be moved.

If EB3 ROW becomes current or close to current next visa bulliten there might be some movement for India and china in coming months or atleast IN FY 2009.

It ironic that you, of all people who got a GC through EB1, are questioning the importance of intellect over physical labor. It is no secret that human civilization has progressed and prospered only because some people have thought hard and attempted to invent new things. And the current EB preference system clearly reflects that importance of intellectual advancement to any society.
The cabbie or the waiter, with due respect their profession, is a mere cog in the wheel; a facilitator. But you my friend, the high skilled immigrant, have the ability to innovate and help your society progress. You have the education and understanding that can be passed on to future generations.
It is not to say that the waiter cannot invent, but the fact of the matter is five years on and he is still waiting tables.
I wonder if you were waiting in limbo for five-six-seven years, would you have still made this callous remark?
what makes you think you are more important to american society than the waiter or the cabbies? we all come to US under full disclosure but a hope that by the time our turn at GC (and Citizenship for those who care) comes - the queues would have shortened or the rules would have changed in our favor and we wont have to wait for so long......

I had been in US for 6 years and has a PD of October 2006, that means i have to wait a long time to get my GC. but i got my back up plans prepared. It tends to irriate me but the only way to solve is to get involved in some kind of activity. I would suggest get involved in IV. Atleast you will feel much better that you are helping a community that lead you to get your GC soon.

Both parties ( employee and employers) bend letter and spirit of law. Think fake resumes, references, experiences on employee side. Think no salary on bench, lack minimum professional decorum, professional ethics on employers side. But overall my sympathies are with employee and more so in this case.

-- 25k because its just not about H-1b costs. Its business. Business needs to make profits and be healthy. Business dont want H-1B employees who would like to stay for less than an year. It affects other H-1B employees and their immigration process. Businesses hate to ask H-1Bs from INS and cancel H-1s. It puts a blotch on the Business. Afterall INS give H-1B approval hoping that the employee works with the employer for atleast 3 years .
Hoarding I-140, labor certificatio etc and giving no visibility is another deal breaker.I just dont get it.

Being a small world goes on both sides.

For a techie, clilent is king. I would never displease the ultimate beneficiary of my services. Even after my project is over, I keep in touch, do occasional free consulting all in hope of building my network. But for employers like these, who add no value, i have no sympathies.

Yes, Microsoft and many other major employers could easily find qualified US students with two years of experience, skills by the way comparable to what the vast majorities of H1B's offer, but Americans who do not need the H1B would give a finger to any employer who would expect that an American would work 80h/week for 55K/year.
Hmm, so one would conclude that immigrants work harder than the natives. What is stopping the natives from working as hard? At the very least the immigrants are keeping natives honest and increasing competitiveness.
You also misunderstand the chief reason why younger employees work long hours. It is because they want to learn and become more productive in the future, so they can make more money, not because their job depends on it.
The illegal aliens are being backed by major employers of cheap labor, such as Wall Mart and many others. Illegals also can put extra long hours and therefore they yield more output for less investiment. That's is the reason that US employers seem to fight so consistently to keep them here.
This may well be true for illegals. In fact it is true for any work that is well understood.
By its very nature high skilled workers are expected to perform leveraged work where there isn't a direct correlation between results achieved and the number of hours worked.
For the naive and dreamers out there who are shaking their heads after reading the above and believe that employers cannot find qualified applicants, so just answer this:
How many million dollars per year are the top management of Fortune 500 companies making? The US is not about drastic wages inequalities. This is about paying a fair salary, otherwise we have increasing salary inequality and this should be renamed then to Mexico, India or something like that.
